1. AGREEMENT TO TERMS

This Terms of Service Agreement (“Agreement”) is entered into by and between DTV Agent (“Company,” “we,” “us,” or “our”) and you (“User,” “you,” or “your”). This Agreement governs your access to and use of dtvagent.com (“Website”) and all related services provided by DTV Agent (“Services”).

By accessing, purchasing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these Terms, you must immediately discontinue use of the Website and Services.

1.1 No Affiliation with Government Authorities
DTV Agent is an independent informational resource and is NOT affiliated with the government of the Kingdom of Thailand, the Royal Thai Embassy, or any official immigration authority. The Services provided are strictly for informational purposes, and Users are solely responsible for verifying visa details with the appropriate Royal Thai Embassy or consulate.

2. SERVICES PROVIDED

DTV Agent provides the following Services:

• AI-powered chatbot: Assists Users with general information regarding the Destination Thailand Visa (DTV).
• Visa cover letter templates: Designed to aid in the preparation of visa applications.
• Additional resources and guides: Offer insights into the visa application process.

2.1 Important Service Limitations
DTV Agent does NOT provide legal, immigration, or visa application services.
DTV Agent does NOT guarantee the approval of any visa application.
All visa decisions rest solely with the government of the Kingdom of Thailand and its relevant immigration authorities.
Users are responsible for verifying all visa‑related information with the Royal Thai Embassy, consulate, or an official government source.

3. USER ACCOUNTS & RESPONSIBILITIES

3.1 Account Creation
A User account is automatically created upon purchasing our Services.
You must provide accurate and complete registration details.
You are responsible for maintaining the confidentiality of your login credentials.
You must not share your account or allow unauthorized access.

3.2 Prohibited Conduct
You agree not to:

• Use our Services for fraudulent or unlawful purposes.
• Misrepresent yourself as an official representative of the Kingdom of Thailand.
• Manipulate, abuse, or misuse the AI chatbot for deceptive or misleading purposes.
• Violate any applicable laws, regulations, or policies of the Kingdom of Thailand.

4. PAYMENTS & REFUND POLICY

4.1 Payments
All payments are processed securely via Stripe.
By making a purchase, you authorize DTV Agent (or its designated payment provider) to charge your selected payment method.

4.2 Refunds & Chargebacks
All payments are final and non-refundable.
Users waive their right to initiate chargebacks for Services already provided.
In the event of an unauthorized payment dispute, Users must contact us before initiating a chargeback through their financial institution.

4.3 Future Paid Services
DTV Agent reserves the right to introduce additional paid services in the future, which shall be governed by an updated version of this Agreement.

5. USE OF AI TECHNOLOGY

The AI chatbot is powered by OpenAI API and is trained exclusively on publicly available DTV visa information.
The chatbot does not provide legal advice or guarantee visa approvals.
AI‑generated responses may be outdated, incomplete, or inaccurate.
Users must verify all information independently with the Royal Thai Embassy, consulate, or an official government source.
DTV Agent disclaims all liability for decisions made based on AI‑generated responses.

6. DATA COLLECTION, PRIVACY & SECURITY

6.1 Data We Collect
DTV Agent collects only the necessary data required for account creation and transaction processing, including:
– Name and email address (for account management).
– Payment details processed securely via Stripe (DTV Agent does not store payment card information).
– Website traffic data via Google Analytics.

6.2 Data Deletion Rights
Users may delete their personal data at any time via the Security tab in their profile settings.
However, DTV Agent may retain certain transaction records as required by law for fraud prevention and tax compliance.

6.3 No Data Sharing or Selling
DTV Agent does not sell, share, or distribute personal data to third parties.

7. LIMITATION OF LIABILITY

7.1 No Guarantee of Visa Approval
DTV Agent makes no representations, warranties, or guarantees regarding the approval or success of any visa application. All visa approvals, rejections, and related decisions rest solely with the government of the Kingdom of Thailand and its designated immigration authorities.

7.2 No Legal or Immigration Advice
The information provided by DTV Agent is for general informational purposes only and does not constitute legal, immigration, or professional advice. Users are strongly encouraged to consult with the Royal Thai Embassy, consulate, or a qualified immigration lawyer for official guidance.

7.3 Limitation of Damages
To the maximum extent permitted by law, DTV Agent’s total liability shall be limited to the amount paid by the User for the Service in the past 12 months or £100 GBP (whichever is lower).

7.4 Force Majeure
DTV Agent shall not be liable for service disruptions, delays, or failures caused by events beyond its reasonable control, including but not limited to:
– Acts of God, natural disasters, or pandemics.
– Cyberattacks, data breaches, or unauthorized third-party interference.
– Changes in visa regulations, government policies, or geopolitical developments that impact visa processing.

8. GOVERNING LAW & DISPUTE RESOLUTION

8.1 Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of England and Wales.

8.2 Dispute Resolution
Users agree to attempt informal resolution of any dispute by contacting DTV Agent before taking legal action.
All disputes shall be resolved through binding arbitration under the London Court of International Arbitration (LCIA) Rules in London, United Kingdom.
By using our Services, Users waive any right to file claims in courts outside of England and Wales.

8.3 Class Action Waiver
All claims against DTV Agent must be brought on an individual basis. Users waive the right to participate in any class‑action lawsuit, collective action, or other representative proceeding.

9. CHANGES TO TERMS OF SERVICE

DTV Agent reserves the right to update or modify this Agreement at any time.
Users will be notified of significant changes via email or a notice on the Website.
Continued use of our Services after such updates constitutes acceptance of the revised Agreement.
